So, when should you tell people that you’ve used an AI app to write the information you share with customers? The answer is easier than you may expect.
In a video posted to his YouTube channel, Colorado-based lawyer Mark Lyda of Lyda Group asked ChatGPT about plagiarism, the practice of taking someone else’s work or ideas and passing them off as one’s own. It replied that any text generated by the model should be clearly marked as such and the source should be properly cited.
He agrees that any research project should credit the sources you’ve used. But once the writing is done, who owns the end product? He addresses that question in a second video.
Under copyright law, creators generally own their work, but since the people provide prompts to change the text or image, that could change the dynamic, Lyda explains.
OpenAI addresses that clearly in its terms and conditions: “OpenAI hereby assigns to you all its right, title and interest in and to output. This means you can use content for any purpose, including commercial purposes such as sale or publication, if you comply with these terms.”
“At least as of now, you can use everything that ChatGPT gives you,” Lyda says. “You own the responses that ChatGPT gives you. Why? Not because of an existing law but simply because Open AI… is giving it to you.”
